TERMS & CONDITIONS
1. By a) enrolling a dog with or b) permitting a dog to attend or c) accepting the Services of The Dawg House Day Care & Boarding and its staff, the Client is deemed to have accepted these Terms and Conditions.

2. I further understand and agree in admitting my dog that The Dawg House Day Care & Boarding has relied on my representation my dog is in good health and has not harmed or shown aggression or threatening behaviour toward any person or any other dog.
​
3. I further agree to notify the Dawg House Day Care & Boarding of any unwelcome, aggressive, procreative, or dangerous behaviour of my dog that has potential to cause harm to any other pet or individual.

4. I understand that I am solely responsible for any and all harm caused by my dog while my dog is attending The Dawg House Day Care & Boarding, or using any services provided by The Dawg House Day Care & Boarding .

5. I further understand that during normal dog play, owner’s dogs may sustain injuries. All dog play is carefully monitored at The Dawg House Day Care & Boarding to avoid injury, but scratches, punctures, torn ligaments, or other injuries that may occur despite the best supervision.

6. I further understand that The Dawg House Day Care & Boarding is a place where animals co-mingle in groups, at the centre and on walks and I am responsible for the medical treatment of any injuries or illness that my dog receives while at The Dawg House Day Care & Boarding. I agree to pay all costs for my dog that may arise as a result of injury or illness, including veterinarian care and costs. The Client will take responsibility for any costs which may be incurred, by either veterinary or other, as a result of any damage, accident, or sickness caused to or by their dog and will pay any such costs or expenses on demand.

7. I further understand that if I fail to provide proof of current vaccinations or if my dogs’ vaccinations are found to be expired or otherwise incomplete, The Dawg House Day Care & Boarding has the right to refuse service until current proof is provided.

8. I further understand and agree that any behavioural or health problems that develop with my dog will be treated as deemed best by the staff at The Dawg House Day Care & Boarding, in their sole discretion, and that I will assume full financial responsibility for any and all expenses involved. I authorise The Dawg House Day Care & Boarding to obtain medical records and/or treatments for my dog in the event of injury or illness from my vet or from the closest veterinary clinic. By signing this document and/or the consent form, I further direct said vet to provide such records upon request.

9. I further understand that my dog should be castrated (if male and over the age of 12 months) or spayed (if over the age of 6 months) to enrol at Barking Mad Day Care & Boarding. Un-neutered dogs and un-spayed bitches may be accepted under prior arrangement with The Dawg House Day Care & Boarding but in these circumstances, bitches must not be brought when ‘on heat’.

10. I further understand that even if my dog is vaccinated for Bordatella (Kennel Cough) there is a chance that my dog can still contract Kennel Cough. I agree that I will not hold The Dawg House Day Care & Boarding responsible if my dog contracts Kennel Cough while attending The Dawg House Day Care & Boarding.

11. I further agree to notify The Dawg House Day Care & Boarding of infectious and/or contagious disease or conditions my dog has been exposed to or is affected by. Such diseases and conditions include, but are not limited to Distemper, Hepatitis, Kennel Cough (Bordatella), Parvovirus, Corona virus, worms, Lyme disease, Fleas, Pregnancy, Infectious Skin Diseases and Intestinal Parasites.

12. I further agree to take any necessary efforts or precautions to insure that my dog is continuously free of contagious, infectious, or otherwise communicable diseases. I will report to The Dawg House Day Care & Boarding, before arriving or collection at day care, any contagious, infectious or otherwise communicable diseases, and will not be allowed to bring my dog to Barking Mad Day Care & Boarding, regardless of scheduled days, until the condition is resolved. Resolution is determined by The Dawg House Day Care & Boarding.

13. I allow and consent my dog to being photographed, videotaped, and/or used in any media or advertising by The Dawg House Day Care & Boarding without prior approval by me. All such photographs, etc. Are the property of Barking Mad Day Care & Boarding.

14. I further agree to pay all fees set forth by The Dawg House Day Care & Boarding and understand that I will be charged in full for my scheduled day regardless of my dog’s attendance and I understand I will be charged £5 for every 15 minutes or part thereof past the scheduled pickup time.

15. The Client may not swap their agreed regular days on an ad hoc basis. It may be possible to add occasional extra days as required, provided there is space. Requests to do so should be via the website. These additional days are required to be paid in full before or on the day.
​
16. Full payment for services (agreed either at time of booking or subsequently) is to be when the booking is made. Time for payment shall be of the essence of the Contract. The preferred method of payment is via the website, cash or BACS transfer is also accepted, via prior approval. If the Client fails to make any payment due to The Dawg House Care & Boarding under the Contract by the due date for payment, then the Client shall pay interest on the overdue amount at the rate of 8% per cent per annum above Lloyds Bank Plc’s base rate from time to time. Such interest shall accrue on a daily basis from the due date until actual payment of the overdue amount, whether before or after judgment. The Client shall pay the interest together with the overdue amount plus any and all additional administrative, debt collection costs and legal fees incurred.

17. The Dawg House Day Care & Boarding operates an online booking system, any amendments/cancellations to days booked and paid for need to be advised 24 hours before the day booked. No fee shall be refunded for any cancellation after this time.
​
18. The Client shall pay all amounts due in full without any set-off, counterclaim, deduction or withholding (except for any deduction or withholding required by law). The Dawg House Day Care & Boarding may at any time, without limiting its other rights or remedies, set off any amount owing to it by the Client against any amount payable by The Dawg House Day Care & Boarding to the Client.

19. The Dawg House Day Care & Boarding shall not be liable to the Client, whether in contract, tort (including negligence), for breach of statutory duty, or otherwise, arising under or in connection with the Contract for:
a. loss of profits, sales or business;
b. loss of agreements or contracts;
c. loss of anticipated savings;
d. loss of damage to goodwill; and any indirect or consequential loss.

20. The Dawg House Day Care & Boarding’s total liability to the Client, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with the Contract shall be limited to £1,000 or the total fees paid under the Contract, which ever is lower.
​
21. The terms implied by sections 3 to 5 of the Supply of Goods and Services Act 1982 are, to the fullest extent permitted by law, excluded from the Contract.
​
22. This clause 20 shall survive termination of the Contract.
​
23. In agreeing to the figure set under clause 20 above the Client agrees that he/ she is able to insure the Client’s dog under a pet insurance policy and is likewise able to insure home and property contents under a house and contents insurance policy. The Client is advised to notify his/her insurers of the day care arrangement in order to be covered under the pertinent insurance policies. The Client understands that Barking Mad Day Care & Boarding is only able to offer its competitive fees on the basis of its Clients insuring its pets appropriately.

23. The client must inform us if your dog attends or attended another kennel, boarding, day care or mass public event. This is to ensure we can identify and trace any contiguous diseases.
​
24. I understand that The Dawg House Day Care & Boarding is not responsible for any lost, stolen, or damaged toys, leads, collars, beds, tags, clothing or any other item left with my dog.
​
25. I agree to ensure my dog has eaten at least 2 hours before arrival at The Dawg House Day Care & Boarding so he/she has time to digest his/her food before all the excitement. I understand that failure to do so may result in Bloat, which is very dangerous.
​
26. Abuse or aggressive behaviour towards staff members will not be tolerated and may result in cancellation of your contract with no refund.
​
27. I further understand and agree that each of the foregoing provisions are separate and severable and shall be in force and effect on each and every occasion my dog attends The Dawg House Day Care & Boarding.
​
This statement shall remain in full force and effect as between the parties until and unless otherwise amended or revoked, cancelled or superseded in writing signed by both parties.
​
I certify that I have read and understand the terms and conditions forth in this Service Statement, the Application form, including health forms, which are hereby incorporated into this Service Statement by reference. I agree to abide by the terms and conditions and accept all terms, conditions, and statements of this statement.

Each party agrees that it shall have no remedies in respect of any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in this agreement. Each party agrees that it shall have no claim for innocent or negligent misrepresentation or negligent misstatement based on any statement in this agreement.

I hereby release The Dawg House Day Care & Boarding their staff, and volunteers of any liability of any kind whatsoever arising from my dogs’ attendance and participation at The Dawg House Day Care & Boarding.
​
This agreement constitutes the entire agreement between the parties and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.
